SO excited to be announcing our 2019 Pajama Christmas Mini-Sessions in The Woodlands, TX. We’re doing Christmas minis a little different this year! Let’s have fun INSIDE in a beautiful natural light studio with bright white walls and beautiful white washed brick in the North Woodlands/Magnolia area. I’ll have a bed for the kiddos to jump on or to pile your family onto in their pjs or I’ll have a nice comfy chair for a more traditional look if pajamas aren’t your thing. Doesn’t A/C during Christmas portraits sound like a dream!? Plus no rescheduling for weather either! I wanted to keep these sessions short and affordable so they’re painless for your wallet and your patience on picture day!

TERMS & CONDITIONS: By paying this mini-session package fee, the Client acknowledges that they have received, read, and agreed to all terms indicated in the information above and agreement below, and agrees to relay the details of this contract to any and all subjects involved in the session.
SERVICE COVERAGE & PAYMENT: The Client agrees that JW Baugh Photography (hereinafter referred to as JWB) will furnish the services of professional photography for the selected session and time slot. Receipt of the payment officially reserves JWB’s services for the selected date/time.
CANCELLATION: In the event of a cancellation on behalf of the Client, the package payment is non-refundable. There will be no reschedule date due to weather because we’ll be inside for these sessions.
LIMITATION OF LIABILITY: JWB takes the utmost care with respect to the exposure, development, storage and delivery of photographs and will make every reasonable effort to satisfy the Client. JWB shall have no responsibility for fire or theft or liability for failure to supply any service when prevented from so doing by death, accidents, illness, equipment malfunction or any cause beyond JWB’s reasonable control. This limitation of liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or compact flash card malfunction, lost in the mail, or otherwise lost or damaged without the fault of JWB. In such case, JWB’s entire liability is limited to a proportional refund for those services and/or products affected.
REVIEW, SELECTION & DELIVERY TIME: JWB will produce an online gallery for the client to view within two weeks from the date of shooting the session, at this time the client will have one month to choose their favorite 5 images. Once client informs the photographer of favorite images, they images will be delivered via email within one business day. Edited images will be kept on file for a maximum of three months following the session.
CREATIVE LICENSE & RETOUCHING: All images are to be edited at JWB’s discretion prior to delivery, with JWB being granted total artistic control over the final images. The Client understands that the images JWB aims to produce will be of similar style and caliber to the images shown on the JWB website and blog. JWB maintains a natural approach for image editing in the form of basic white balance, exposure, and contrast adjustments. Although efforts may be made to avoid environmental issues and effects, JWB is not responsible for the retouching of any image, including but not limited to the correction of blemishes, hair/makeup, environmental effects, clothing, reflections in glasses, as well as the removal/insertion of fixtures, etc. All images will be delivered in color for the purpose of being printed in either color or black and white.
TIME RESTRICTIONS: Client lateness will result in a shorter session and the possibility of proportionally less images received. The Client agrees to allow JWB full creative control over the session including suggestions of location and pose. JWB will not be held responsible for any injuries, vehicles’ towing, etc. which occur during or after a session.
MODEL RELEASE & USE PERMISSIONS: The Client agrees that JWB may reproduce, publish, or exhibit a judicious selection of such photographs as samples of photographic work to be shown to prospective clients in the form of in-studio displays, advertising, website and blog images, and for instructional or institutional purposes consistent with the highest standards of taste and judgment. The Client hereby waives the right to inspect and/or approve any finished product or the written copy that may be used in connection therewith, or the use to which it may be applied.
FEDERAL COPYRIGHT LAWS: JWB owns all original files and retains the rights to reproduction of any images produced in connection with this agreement. Profiting off of any photograph is hereby prohibited and protected under Federal Copyright Laws, and will be enforced to the full extent of the law allowable.
SEVERABILITY: In the event of failure to comply with the terms of this contract, liability of JWB is limited to refund of monies paid in the contracted amount. All parties to this contract hereby agree that said refund shall terminate any further liability to this agreement.
